Organizers run their own towns — they're not our employees. Disputes go to arbitration, not court. We're protected under Section 230 for what others post.

Acceptance of terms

By using What's Local Now — whether as a reader, subscriber, submitter, organizer, or sponsor — you agree to these Terms of Service. If you do not agree, please do not use the platform.

What this platform is

What's Local Now is a trade name of EQ Design, an Idaho S-corporation. What's Local Now is a community bulletin platform for small towns. Volunteer community organizers create and manage town bulletins. Approved submitters post local information. Readers access that information for free.

We are a platform, not a publisher. We do not create the content posted to town bulletins — community members do. However, we reserve the right to remove content that violates these terms.

Section 230 — Platform provider status

What's Local Now is an "interactive computer service" as defined by Section 230 of the Communications Decency Act (47 U.S.C. § 230). We are not the author, editor, speaker, or publisher of any user-generated content posted to this platform. Under Section 230, we are not legally responsible for content created or posted by third parties, including community submitters and organizers.

We may, at our sole discretion, remove content that violates these terms or that we find objectionable for any reason, without notice and without liability. Exercising this editorial discretion does not make us a publisher or speaker of any content we choose not to remove.

Submitter rules

By submitting content to any town bulletin, you agree that your content:

The town organizer has full discretion to approve, remove, or reject any submission. Their decisions are final for their bulletin. What's Local Now also reserves the right to remove any content and suspend or terminate any account at any time, for any reason, without prior notice.

Organizer responsibilities

Organizers are independent community volunteers. They are not employees, agents, contractors, or representatives of What's Local Now. We are not liable for any moderation decisions made or not made by individual organizers, including failure to remove content, wrongful removal of content, or any harm arising from their management of a town bulletin. By becoming an organizer, you accept sole responsibility for the day-to-day operation of your bulletin.

Tips and sponsorships

Readers may choose to tip a bulletin organizer as a voluntary expression of appreciation. Tips are processed by third-party payment providers. What's Local Now takes no portion of tips.

Sponsorship arrangements are between the sponsor and the bulletin organizer. What's Local Now is not a party to those arrangements and is not responsible for fulfilling sponsorship commitments.

Content ownership

You retain ownership of any content you submit. By submitting content, you grant What's Local Now a non-exclusive, royalty-free license to display, distribute, and format your content as part of the bulletin platform. You can request removal of your content at any time by contacting the town organizer or emailing us.

Indemnification

You agree to defend, indemnify, and hold harmless What's Local Now, its owners, officers, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the platform; (b) your violation of these terms; (c) your violation of any third-party right, including any copyright, trademark, privacy, or defamation right; or (d) any content you submit to the platform. This indemnification obligation will survive the termination of these terms and your use of the platform.

DMCA — Copyright takedown procedure

What's Local Now respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe that content posted on this platform infringes your copyright, please send a written notice to our designated DMCA agent at dmca@whatslocalnow.com containing:

Upon receipt of a valid DMCA notice, we will remove the allegedly infringing content and notify the submitter. Submitters who believe their content was wrongfully removed may submit a counter-notice to the same address. Repeat infringers will have their accounts terminated.

Privacy

Your use of the platform is also governed by our Privacy Policy, which is incorporated into these terms by reference.

Disclaimer of warranties

The platform is provided "as is" without warranty of any kind. We do not guarantee that the platform will be available at all times, that content will be accurate, or that the platform will meet your specific needs.

Limitation of liability

To the fullest extent permitted by applicable law, What's Local Now and its owners, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, goodwill, data, or other intangible losses, arising out of or in connection with: (a) your use of or inability to use the platform; (b) any content posted by users; (c) any conduct or content of third parties on the platform; or (d) unauthorized access to or alteration of your content or account.

In no event shall our total liability to you for all claims arising from your use of the platform exceed one hundred dollars ($100). Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

Termination

We reserve the right to suspend or terminate any account that violates these terms, at our sole discretion and without prior notice. Organizers may also remove any submitter from their bulletin at any time.

Changes to these terms

We may update these terms from time to time. We will update the date at the top of this page when we do. Continued use of the platform after changes are posted means you accept the updated terms.

Dispute resolution and arbitration

Any dispute, claim, or controversy arising out of or relating to these terms or your use of the platform shall be resolved through binding individual arbitration, not in court, except that either party may bring claims in small claims court if they qualify. You waive your right to participate in a class action lawsuit or class-wide arbitration.

Arbitration shall be conducted by a single arbitrator under the rules of the American Arbitration Association (AAA), or by a mutually agreed alternative. The arbitration will take place in Oneida County, Idaho, or by telephone or videoconference. The arbitrator's decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Before initiating arbitration, you agree to first contact us at hello@whatslocalnow.com and give us 30 days to resolve the dispute informally.

Age requirement

You must be at least 13 years old to use this platform. By using What's Local Now, you represent and warrant that you are 13 years of age or older. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these terms on your behalf. We do not knowingly allow children under 13 to create accounts or submit content. If we become aware that a user is under 13, we will terminate their account and delete their information promptly.

CAN-SPAM compliance

All email communications sent through the platform by EQ Design d/b/a What's Local Now comply with the CAN-SPAM Act. Every email includes a clear and conspicuous unsubscribe mechanism. We will honor all unsubscribe requests within 10 business days, though we typically process them within 48 hours. We do not send deceptive subject lines or misleading sender information. Governing law and venue

These terms constitute a binding agreement between you and EQ Design, an Idaho S-corporation doing business as What's Local Now. They are governed by the laws of the State of Idaho, United States, without regard to conflict of law principles. For any matters not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Oneida County, Idaho.
